These Terms of Service ("Terms") are a legal agreement between you and Hukt AI, Inc. ("Company," "we," "us," or "our") governing your use of Crowbert at crowbert.com and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.
You must be at least 16 years old to use the Services. You agree to provide accurate registration information, keep your account credentials secure, and remain responsible for all activities under your account.
Crowbert may include personal and organization workspaces. Workspace owners and admins are responsible for user permissions and actions taken within their workspace. You represent that you have authority to act on behalf of any organization you manage through the Services.
Certain features require payment, including subscriptions and token purchases. Payments are processed by third-party payment processors. You authorize us to charge the payment method associated with your account for applicable fees, taxes, and renewals, if any.
All payments are non-refundable except where required by applicable law. We may change pricing or plan features by providing notice through the Services or by email.
You agree not to misuse the Services. This includes, without limitation, violating laws, infringing intellectual property or privacy rights, distributing harmful code, attempting unauthorized access, interfering with service operation, or using the Services to create unlawful, abusive, deceptive, or fraudulent content.
You retain ownership of content you submit to the Services ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, process, copy, transmit, and display User Content as needed to provide, secure, and improve the Services.
You represent and warrant that you have all rights required to provide User Content and to authorize its use under these Terms.
Crowbert includes AI-assisted features. AI outputs may be inaccurate, incomplete, or not fit for a specific purpose. You are solely responsible for reviewing and approving outputs before use, publication, or reliance. We do not guarantee the accuracy, legality, or originality of AI-generated output.
The Services may integrate with third-party services. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services, products, content, or outages.
We may suspend or terminate access to the Services at any time, with or without notice, for violations of these Terms, security risks, legal requirements, payment failures, or abuse of the Services.
You may stop using the Services at any time. Provisions that by their nature should survive termination will survive, including payment obligations, limitations of liability, disclaimers, and governing law.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUKT AI, INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.
You agree to defend, indemnify, and hold harmless Hukt AI, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, and expenses arising out of or related to your use of the Services, User Content, or violation of these Terms or applicable law.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction and venue of those courts.
We may update these Terms from time to time. We will post the updated version and email registered users for any changes. Continued use of the Services after changes become effective means you accept the updated Terms.
